LJ Biz post -- though I'm sure you've all seen it by now.

Hi, Skyehawke anyone?

It really doesn't affect me as I don't really write chan. I should check the ages on some fics, just to double check (as I'm not sure what the age is on my one Remus/Harry) -- but dude. I keep my boys at LEAST over 16. *shakes head* this is ridiculous. I'm not really wanting to move from LJ as I have so many friends here.

Don't you all just love the timing? Considering a good portion of fandom is at Sectus... and another large portion is away avoiding Spoilers.

Chan, actually, squicks me. Yeah, I've written Remus/Harry and Remus/Hermione -- but I always get them close to age of consent.

Which is my issue because, correct me if I'm wrong, the age of consent isn't necessarily 18. It varies state to state. Or, you know, there's always emancipated minors. Which they support themselves.

It's the blanket statements and the unwillingness to actually answer questions that bothers me.

I'm the exact same way. I hardly ever write about characters under 16, but I've done my fair share of 7th year fics.

And yeah, the original poster specifically said that even though the age of consent varies, LJ's policy is under 18. My jaw nearly dropped to the floor when I read that.

Exactly. I know I have some 7th year (or yea about) fics floating around somewhere.

My jaw is too. This is just... this is getting absolutely ridiculous. Do we need to, once more, show them how much money they take in from fandomers. And that -- you know, fanfiction has been around for a very long time, whether or not it contains chan or underage. I don't think we've managed to 'promote' it to the masses.

Just give us our own little corner of fandom, you know? We're really not hurting anyone. I could understand Skyehawke and the kerfuffle because it was illegal there. This just looks like bending things to get laws to support them. *thinks we should all start finding the loopholes ourselves*

This entire thing pisses me off. I've written underage smut(, though I can argue that it has literary value. "Don't play with Time-turners." -nod- >_>;;)

I hate the fact that they're using opposing definitions. For example, the age of consent in North Carolina is 16 and they reference obscenity laws, but they're saying anything under 18 is banned. They really need to get their facts straight.

It's a total conspiracy, and anyone who thinks otherwise is clearly not paranoid enough.

I'll add to the conspiracy theory. Want to bet LJ didn't make as much money this time around with Permanent Accounts as they expected? So, rather than keep us around, get us pissed off enough to shove off.

*g* I think we should. We'll start a trend. So long as there's merit -- they didn't say if it had to be actual moral and true literary merit. I say the merit could be "remember kids, this is why you use lube."

It seems as if it is such a nice time to let us know. *sighs* I suppose I have to pack my suitcases, having a deep love for young SS/LM fics, even though they are both under 18 then... but it doesn't seem to matter.

It does, it's allowed here in Denmark, just as in Holland and Sweden, and actually (I have a US lawyer sitting next to me) in US; only LJ isn't following the law in this, with the 18 year limit and the fictional texts.

Apart from that I don't think we have to pack, but we have to realise journals be purged if anyone directs abuse team's attention to fictional smut, even if the characters are allowed to do what they do in your particular state or country.

It really seems as if LJ/6A is twisting things to suit their own needs.

I'm not ready to pack up and move at all. More -- I'm wanting to stay just to spite everyone to be perfectly honest.

I also say -- we all should start adding the tag of 'literary merit' to fanfic headings.

Hmm as long as smut is well written, I can see artistic value in it. But I wonder if my definition of artistic value is the same as the Miller Test's? (Doubtful, but not impossible). It's all very confusing.

Still, I do wonder if they really are going to take action against anyone caught writting smut about people under 18? It's unclear to me whether the WfI incident has really set a precedence or not for LJ taking action against 'underage smut'.

I don't write chan either. I have written fic involving sexual situations with 15 to 17 yr olds (usually with one another) and one with a 13 and 15 year old masturbating. This is not illegal. It's not obscene in my opinion. There were points to every story, as far as I'm concerned. However, if someone else who is in charge policing this bullshit does, I'm fucked.
